Our experience in the fields of Dispute Prevention and Dispute Resolution shows that numerous costly and lengthy legal battles need not have been fought and that better outcomes could have been achieved if some basic rules and guidelines were observed from the outset in analyzing and managing the conflict.

Dispute Management starts before a conflict has arisen. It can start as early as drafting the appropriate dispute resolution and choice of law clauses in contracts, which require not only a thorough knowledge of the various options but also the ability to tailor these clauses in accordance with all relevant factors. It can also arise early on in a dispute, to understand how to contain it and prevent it from escalating into a formal or legal conflict. Once a dispute arises, a careful and recurring analysis is essential in order to determine the most promising strategy and to achieve the best solution. It is vital in formal conflict situations such as litigation or arbitration to adhere to effective and efficient metrics as of the commencement of the proceedings and to balance costs, potential outcomes and overall risk assessments regularly. Alternative Dispute Resolution (ADR) methods, such as mediation and conciliation, can be used early on to help the parties better understand their interests and how to possibly resolve the matter more cost-effectively.

Our firm offers trainings in Dispute Management (i.e. dispute prevention and resolution strategies) for business executives who are dealing with legal controversies and seeking to manage them from a business perspective. The training is intended to provide a sound understanding of how disputes can be prevented and how better outcomes can be achieved.
