Peter R. Altenburger publishes the first edition of “Internationales Steuerrecht der Schweiz in a nutshell”

This new book by Peter R. Altenburger is an introduction and shall provide the reader with an overview of Switzerland’s international taxation which has developed significantly in the past years.

Switzerland is a strong advocate of the bilateralism and has entered into nearly 100 double taxation agreements. Based on inbound transactions and thus from a notional foreign investor’s point of view Peter demonstrates the nature and function of a double taxation agreement including the international exchange of information. Due to the fact that the TIEAs („Tax Information Exchange Agreements“) have been highlighted by the OECD and the banking secrecy has tumbled, exchange of information between countries has become a legal discipline of its own.

Before focusing on these international aspects the national legal basis needs to be developed. Who is resident in Switzerland and who has merely an economical connection to Switzerland?

Every notional foreign investor has to be aware of Swiss withholding tax issues. Swiss withholding tax is a “trap of the unwary” into which one should rather not step. Even 40 years after its implementation the withholding tax of 35% is notorious and has left its marks.

Finally, Peter demonstrates on the one hand Switzerland’s advantages for notional foreign investors and on the other hand the reasons for Switzerland’s conflict with the EU.
